Introduction

This contract will be governed by French law. 

The contractual information is presented in French and the products offered for sale comply with French legislation. 

Where relevant, it is up to foreign buyers to check with their local authorities whether the product they are considering buying can be used. Easyautom.com cannot be held liable in the event of failure to comply with the regulations in a foreign country where the product is delivered. 

The specifications of the items offered for sale are described on the easyautom.com site, and full specifications can be found on the manufacturers' websites. Photographs are non-contractual. Easyautom.com cannot be held liable for errors in the photos or text. All the text and images on the easyautom.com site are protected worldwide by copyright and intellectual property law and may not be reproduced, even partially. 

The products available from easyautom.com are aimed at professional customers. Easyautom.com reserves the right to refuse to accept orders from any customer who proves to be a private individual. 

The customer declares that they have all the necessary electrical skills to use the products they buy from the site. The customer assumes sole responsibility for the use of the products.

These terms and conditions of sale are agreed by the company DISTRIBELEC Sarl, with share capital of 50,000 euros, with its head office at 625 rue de l'Industrie, 01480 Jassans Riottier, registered with the Bourg en Bresse companies register under the number 44221903600039, and any natural or legal person wishing to make a purchase via the website www.easyautom.com

Article 1 – Subject
These terms and conditions aim to define the contractual relationship between DISTRIBELEC or the www.easyautom.com website and the buyer. Making a purchase through this site implies that the customer has accepted these terms and conditions of sale without reservation. If any of these terms are found to be invalid, they will be considered to be governed by common practice in the field of distance selling by companies based in France. DISTRIBELEC or www.easyautom.com reserve the right to modify these terms and conditions of sale at any time. If this occurs, the conditions that apply will be those in force on the date when the customer placed the order.

Article 2 – Prices
All the prices of the items are given on www.easyautom.com. DISTRIBELEC or www.easyautom.com reserve the right to modify these prices at any time without notice. The items will be invoiced on the basis of the prices in force when the order was received. The items remain the property of DISTRIBELEC until the full price has been received by DISTRIBELEC.

Article 3 – Orders
The customer may place orders online via the site www.easyautom.com, but DISTRIBELEC reserves the right to cancel or refuse any order from a customer with whom there is an ongoing dispute relative to payment for a previous order. All orders are considered to imply acceptance of the prices and descriptions of the products offered for sale.

The information entered by the customer when placing the order is binding: if there is a mistake in the recipient's contact details, DISTRIBELEC cannot be held liable if it is not possible to deliver the product. Consequently the customer is responsible for the cost of returning the goods. DISTRIBELEC may even invoice the customer for the administration and transport costs associated with returning orders. 

Products are delivered subject to the stocks available and dispatched in order of the orders received. 

If a product is out of stock or the delivery time is considered too long, easyautom.com will inform the customer as quickly as possible. By agreement with the customer, easyautom.com may replace the products ordered with equivalent items or return the value of the products that are out of stock. 

Article 4 – Delivery
4.1 – Delivery procedure
Except in specific cases described in these terms and conditions, the customer is always responsible for the cost of delivery. Products must be delivered to the address given by the customer when entering the order details. For this reason, www.easyautom.com advises customers to check that the information they enter for the delivery of their order is correct. Delivery does not include installing or starting up the product ordered, nor collecting old equipment.

Easyautom.com undertakes to do everything it can to deliver the products ordered as quickly as possible.

The average time varies from 4 to 15 days depending on stock levels, the destination country selected by the customer and the availability of the items from the manufacturer.

The delivery takes place within the allotted time, either with the handover of the product directly to the recipient or, in their absence, with the issue of a delivery notification.

Delays do not entitle the buyer to cancel the sale, refuse the goods or claim any damages with interest. The following are considered to be cases of force majeure, releasing the seller from the obligation to deliver the order: war, riots, fire, strikes, accidents and the impossibility of obtaining supplies.

Goods always travel at the risk of the recipient.

4.2 – Parcel delivery
For products delivered by Exapaq, we only deliver to mainland France and Corsica.
If the customer cannot be present at the address specified on the delivery date, a delivery notification is left in the customer's letterbox and an e-mail or SMS message is sent so that the customer can collect the order from the nearest Exapaq parcel collection point.

It is then up to the customer to contact Exapaq within 48 hours with the parcel number indicated in the dispatch e-mail. After 8 working days, Exapaq returns the parcel to www.easyautom.com. If the customer decides to request a re-delivery, he or she is responsible for the cost and this must be paid before dispatch by contacting customer services. Customers who wish to cancel an order after delivery may request a refund. They are responsible for the cost of returning the product, and a cheque will be sent within 30 days of the returned product being received. If this 30-day period is exceeded for reasons beyond its control, www.easyautom.com will not be liable to claims from the customer. If the customer enters an incorrect address when placing the order, Exapaq will be unable to make the delivery and the product will automatically be returned to www.easyautom.com. If the customer decides to request a re-delivery, he or she is responsible for the cost and this must be paid before dispatch by contacting customer services.

In the event of an anomaly or non-conformity, the customer must refuse the parcel and make a claim as quickly as possible on the date of delivery by contacting the www.easyautom.com customer service department by registered post with acknowledgement of receipt at the following address:

Any claims made beyond this time may be rejected without further recourse for the customer. The absence of a claim or failure by the customer to declare reservations mean that the product delivered is considered to be satisfactory and no subsequent claims are possible. Once the delivery driver has left, if no reservation has been declared on the delivery note the customer may not make any claim to www.easyautom.com (even if the parcel was not opened in the presence of the delivery driver).

4.3 – Delivery time
Delivery times in working days are provided as a guide only, and www.easyautom.com and DISTRIBELEC cannot be held liable for delayed deliveries. To enable the delivery to be tracked, the customer receives an e-mail or SMS message when the product is dispatched ("Product leaving our warehouse"). The delivery times indicated on the product page are a guide only, and www.easyautom.com cannot be held liable for any consequences arising from delayed deliveries. If the parcel is not received within the time indicated, the customer may contact the customer service department, which will determine the reason for the delay and inform the customer. If necessary, www.easyautom.com will open an investigation into the product's progress with the shipper involved. The shipper determines how long this investigation will take.

If and only if the product is not found following the investigation, www.easyautom.com
– sends a replacement product at its own expense, as long as the product is still available and the customer has taken out delivery insurance.
– refunds the price of the order lost by the shipper if the product is no longer available and the customer has taken out insurance.

Customers who have not taken out the optional insurance will receive only the compensation offered by the shipper, limited to €23.02 excluding tax per kilogram up to a maximum of €690.60 excluding tax per parcel within the limit of the actual value of the goods.

www.easyautom.com will never exchange or refund a product before the end of the investigation period, and the customer will thus have no recourse against www.easyautom.com or DISTRIBELEC.

If an order or part of an order is not delivered, the customer has a period of up to thirty (30) days from the indicated delivery date to inform the customer service department.

After these thirty days, no further claims can be made by the customer, which means that all requests for exchanges or refunds will be rejected (except for exchanges under the warranty).

Delays do not entitle the buyer to cancel the sale, refuse the goods or claim any damages with interest. The following are considered to be cases of force majeure, releasing the seller from the obligation to deliver the order: war, riots, fire, strikes, accidents and the impossibility of obtaining supplies.

4.4 – Parcels of over thirty kilograms and large parcels (with one dimension greater than 2 metres)
The delivery will be made by www.easyautom.com's shippers within France.
The parcel will be delivered to the address given by the customer, who undertakes to receive the product ordered.
The delivery times depend on how the parcel is shipped.

Goods travel at the risk of the recipient. The parcel must be opened and the contents checked in the presence of the shipper. If the item corresponds to the order, opening it implies acceptance unless the product is damaged and precise reservations are added to the delivery note.

Deliveries cannot be made to upper floors.The goods will be delivered to the ground floor of the building, or to the front door of a house.

4.5 – Damaged parcels
If the delivery is damaged, the customer must indicate reservations on the shipper's delivery note and these must be confirmed by the delivery driver. If the product delivered appears to be damaged, the customer must report this on the shipper's delivery note with a clear description of the damage (e.g. product missing, box damaged or open etc.).

The wording "subject to unpacking" has no legal value.
The customer must confirm these reservations to the shipper and to www.easyautom.com by registered letter with acknowledgement of receipt within 48 hours.

Article 5 – Payment
Orders can be paid for:
By bank card (Visa, Mastercard, debit card)
Or by bank transfer
Or by PayPal, with additional payment for part of the PayPal transaction fee.

Without prejudice to any legal means concerning the sums due, any sum remaining unpaid on its due date will be subject to late payment interest at the rate applied by the European Central Bank in its most recent refinancing operation plus 10 percentage points. This interest will remain due until the sum payable is settled, including interest. In addition, a fixed debt recovery fee of €40 will be payable by the customer. In addition, DISTRIBELEC may cancel or suspend any orders or deliveries in progress without prior notice and without prejudice to any other means of action.

DISTRIBELEC reserves the right to demand guarantees of payment and of execution of commitments at any point during an order or a contract, even if no payments are missed, and to cancel the remainder of the contract if these guarantees are not provided or appear inadequate.

Article 6 – Characteristics and availability of the products available
The products available are those featured on the www.easyautom.com website. Products are available as long as they are visible on the site and only within the limit of available stocks. The catalogue photographs are not binding. They are as faithful as possible, but cannot guarantee a total resemblance with the product offered, particularly with regard to colours, which can depend on your display settings.

Article 7 – Rights of withdrawal and return

7.1 – General
The customer has a right to cancel an order within 24 hours of placing the order by contacting the customer service department. If the product is undergoing order preparation, transport costs will not be reimbursed.

Otherwise, the provisions of article L 121-20 of the French Consumer Code apply.

In accordance with the provisions of article L 121-20 of the Consumer Code, the customer has a right to return the products within 14 days of receipt of the order. Customers can thus return a product that is not suitable without penalty.

Customers exercising this right in accordance with the provisions of article L 121-20 of the Consumer Code remain responsible for the cost of returning the order.

Requests for returns that reach www.easyautom.com beyond this 14-day period for any reason will not be accepted.

For example, the following reasons will not be accepted:

– inability to contact the customer service department (as the customer can send an e-mail)
– the customer's absence during the 14-day period following receipt of the order by a third party
– delivery of the order to a holiday home or second home
– a product offered by the customer after the 14-day period

7.2 - Product return procedure

If the equipment has been manufactured to order, no return is possible.

To exercise the right of return, the customer must first contact the customer service department by e-mail, specifying "return request" in the subject of the e-mail.

If the order is being returned because of an error by www.easyautom.com or a non-conformity in the product, the Customer Service department sends the customer a Colissimo or equivalent return label enabling the parcel to be shipped at no cost.

The product must be returned to www.easyautom.com in resellable condition, i.e. complying with the return conditions listed below:

  • in its exact original condition
  • in its manufacturer's packaging, which must be intact and still in its cellophane
  • with all the accessories included
  • in perfect working condition
  • showing no traces of use
  • with the instructions

The risk in returning the product, for any reason, lies with the customer. If the shipper loses the product during transport, the customer has sole responsibility and will not be reimbursed by www.easyautom.com.

If the right of return is exercised in accordance with these conditions, the customer will be offered a refund of the cost of the items purchased at the site, excluding the transport costs or discount which remain the customer's responsibility.

The only case in which the transport costs involved in returning the product are refunded to the customer is when the reason for the return is an error by www.easyautom.com.

If the customer chooses to be refunded, www.easyautom.com will do everything it can to reimburse the customer by any means within a period of 30 days from the date of receipt of the returned product. If this 30-day period is exceeded for reasons beyond its control, www.easyautom.com will not be liable to claims from the customer.

If the returned product does not reach www.easyautom.com within the time and under the conditions specified by this article, the customer will not be reimbursed. In this case, if the customer wishes to recover the product, he or she must request it by e-mail from www.easyautom.com, and the product will be resent as quickly as possible if it is still available. The customer is responsible for the cost of re-shipping the product, and must pay in advance by bank card.

7.3 – Exception to the right of withdrawal
If computer software is provided with the items, CDs that have been removed from their cellophane film by the customer cannot be reimbursed or exchanged.

Article 8 – Guarantees and after-sales service
All the equipment we sell benefits from:
– the legal guarantee of conformity
– the legal guarantee against hidden defects
– the manufacturer's warranty of up to 1 year.

The customer is responsible for the cost of returning the items.

DISTRIBELEC or www.easyautom.com undertake to take responsibility for any repairs by the manufacturer under the warranty. Regardless of the problem with your item, a copy of the invoice, the warranty certificate (included in the box) and the return slip must be returned with the faulty equipment.

The manufacturers' guarantees for products marketed by www.easyautom.com do not cover:
– replacing consumables (batteries, bulbs, fuses etc.)
– abnormal or non-compliant use of the products. We therefore recommend that you read carefully the instructions for use supplied with the products and the specifications available from the manufacturer.
– damage due to work carried out by a repairer not approved by www.easyautom.com or the manufacturer.
– damage resulting from a cause external to the equipment (e.g. accident, impact, lightning strike, electricity surge etc.)

www.easyautom.com can never be held liable if the manufacturer refuses to apply the warranty for the reasons above or any other reason.

If the repairs are not covered by the warranty, DISTRIBELEC will issue a quotation.

If the customer accepts the quotation, a cheque or bank transfer for the quotation amount in the name of SARL DISTRIBELEC must be sent to us.

Article 9 – Liability
DISTRIBELEC or www.easyautom.com is obliged only to make its best efforts for all the steps involved in accessing the site, processing the order, delivering the order and any services subsequent to the use of the items purchased. DISTRIBELEC or www.easyautom.com cannot be held liable for any disadvantages or damage inherent in the use of the Internet, such as interruptions to service, external intrusion, the presence of computer viruses or any occurrence qualified as force majeure in accordance with jurisprudence. The items sold are described and presented on the website as accurately as possible. If errors occur on the site despite all our precautions, we cannot be held liable for them. Except for warranty claims, an operation between DISTRIBELEC or www.easyautom.com and its members can no longer give rise to a claim unless it is disputed within 14 days of delivery.

Article 10 – Personal information
Information and data are held about you in order to manage your orders and our commercial relationships. In accordance with the data protection law of 6 January 1978, you have a right to access and correct personal data about you. Just write to us online or by post, stating your full name, address and e-mail address. Our site is also designed to be responsive to the needs of our customers. This is why we use cookies. The purpose of our cookies is to record your visit to our site. Cookies are only used by DISTRIBELEC or www.easyautom.com to improve our personalised service to you.

Article 11 – Intellectual property
All the contents of the www.easyautom.com website are and remain the exclusive intellectual property of DISTRIBELEC. In accordance with the provisions of the French Intellectual Property Code, they may only be used for private purposes, subject to different and possibly more restrictive provisions in the Intellectual Property Code. Any reproduction, total or partial, of the www.easyautom.com site is strictly forbidden.

Article 12 – Conservation and archiving of transactions
DISTRIBELEC or www.easyautom.com will archive orders and invoices on a reliable, long-lasting medium that constitutes a faithful reproduction in accordance with the provisions of article 1,348 of the French Civil Code.

Article 13 – Applicable law and jurisdiction
This contract is governed by French law. In the event of a dispute, the Bourg-en-Bresse commercial court will have sole jurisdiction.
